Terms of Service

Welcome to BeyondScale Technologies Pvt. Ltd. ("BeyondScale," "we," "us," or "our"). These Terms of Service ("TOS"), together with our Privacy Policy ([link to Privacy Policy]), form a legally binding agreement between you ("you" or "user") and BeyondScale regarding your access to and use of our website (www.beyondscale.tech) and the CMMS software application ("Software") and any related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these TOS. If you do not agree to all the terms and conditions of this TOS, you may not access or use the Services.

Eligibility: You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Services. By using the Services, you represent and warrant that you meet these requirements.

Account Creation: To access certain features of the Services, you may need to create an account. You are responsible for maintaining the confidentiality of your account information, including your username and password. You are also responsible for all activities that occur under your account.

Permitted Use: You may only use the Services for their intended purpose and in accordance with these TOS. You are prohibited from using the Services for any illegal or unauthorized purpose, including, but not limited to:

• Infringing on the intellectual property rights of others.
• Violating any applicable law or regulation.
• Distributing viruses or other harmful code.
• Interfering with the security or functionality of the Services.
• Using the Services for any commercial purpose without our express written consent.

The Services contain intellectual property belonging to BeyondScale or its licensors. This includes, but is not limited to, copyrights, trademarks, patents, and trade secrets. You are not granted any ownership rights to the Services by using them.

You may be able to submit content ("User Content") to the Services, such as descriptions of your assets, maintenance procedures, and work orders. You retain all ownership rights to your User Content, but by submitting it, you grant BeyondScale a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute your User Content in connection with the Services.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BEYONDSCALE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR VIRUS-FREE.

IN NO EVENT SHALL BEYONDSCALE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICES, EVEN IF BEYONDSCALE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

We may terminate your access to the Services at any time, with or without cause, and with or without notice. You may also terminate your account at any time.

These TOS shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles. Any dispute arising out of or relating to these TOS shall be subject to the exclusive jurisdiction of the courts located in Hyderabad, Telangana,India.

These TOS constitute the entire agreement between you and BeyondScale with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

If any provision of these TOS is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

We may make changes to these TOS at any time by posting the revised TOS on the website. Your continued use of the Services after the posting of any revised TOS constitutes your acceptance of such changes.
